EB-5 Immigrant Investor Visa
Investors of any nationality may obtain permanent residency for themselves, their spouse, and unmarried children under 21 through a substantial investment in a business that creates or preserves jobs for U.S. workers.


WHAT IS THE EB-5 IMMIGRANT INVESTOR VISA?
It is an immigrant category —not a temporary visa— created by Congress under INA 203(b)(5) and modernized by the EB-5 Reform and Integrity Act of 2022 (RIA), which allows foreign investors to obtain conditional permanent residency in exchange for an investment that creates at least 10 full-time jobs for U.S. workers.
The most important point: it is open to investors of any nationality.

Investors who invest directly in their own operating business in the U.S. (stand-alone petition, Form I-526)
Investors who participate in USCIS-designated Regional Center projects (Form I-526E)
Entire families seeking permanent residency through a single investment
Investors from countries without E-2 treaty eligibility, or whose Green Card process through employment or family would take decades

✔ Those who will participate in the managerial role or in policy-making activities of the business
✔ Those who can document the creation or preservation of at least 10 full-time jobs
